I've looked at the TEPI event notice
and I have to consider the impact of public nuisance under the Licencing Act for this
Tempe event notice for the 15th of August from 4 till 10 o 'clock in the external area
of Ion Square. Now they've had Tempe events the previous week of the 1st and of the 8th
August and from both of those and there was from both of those we have received
four complaints in total four complaints of loud amplified music and people noise
outside in the park. Sorry Miss Caddell just to interrupt but to be fair to the applicant
obviously what you've got in your representation you've got the
complaints in relation to the first but nothing additional has been added since.
And to be fair, that's all, so if you can confine it to what happened on the first,
that's absolutely fine.
Well, in my representation, this was in regards to a TENS that was granted on the 1st of August
when we received two noise complaints on that night from two individual residents.
They came in to us following on an email reporting
of loud amplified music.
And I quote, loud noise coming from a party outside linked
to love affair basement and customers outside.
And they have hidden speakers in the bushes along
with two large tents in the greenery.
Party is linked to the premises of people
and people going inside.
Now, with regards to this temporary event notice,
I also received a referral from the anti -social behaviour team who had a referral to them
with regards to a live band of four or five people with amplified music, people blocking
the entrance to the park. This they believed was a birthday party. I'm concerned that by
allowing another
10 to go ahead when we've already received
complaints from residents of
amplify music blocking the streets blocking the park
That we're going to continue to get complaints
And I am concerned that the applicant is not promoting the lot of the prevention
They licence an objective of the prevention of public nuisance and therefore I ask that this 10 is not granted

Can you present your opinion, please?
Camilla will speak on my behalf.
Thank you for giving us the opportunity to speak today.
we want to begin by saying that we do take residents' concerns seriously.
We understand that living near a hospitality business
can sometimes mean hearing music, customers and activity,
particularly at weekends.
However, we ask the Committee to consider the full context,
the evidence behind the objections
and our 13 -year history in this neighbourhood.
A Portuguese love affair has been part of Tower Hamlets for 13 years.
We are a small, women -led and q**** -led business
and we have always tried to be a part of the community
rather than simply operate within it.
Our premises are on Hackney Road, a busy road,
and a mixed residential and commercial area.
This has meant in the past that we have also previously
been blamed for noise which was subsequently found
to be coming from other nearby businesses.
For that reason, we believe complaints should be assessed
objectively with the actual source
and level of noise established.
We would therefore ask the committee to consider
how many residents have complained,
are the complaints consistently coming
from the same residents and was the alleged noise actually measured and or witnessed by
the council on the day.
This is important when considering proportionality.
Our relationship with Ironsquare also has a long history.
When we first became involved, the park was in a very poor condition and did not feel
safe.
Residents approached the council, approached us and asked the Portuguese love affair to
help create a safer and more positive environment.
We accepted that responsibility.
Since then, we have supported local musicians, artists and performers,
organised live music and poetry, organised community events,
worked with schools, painted the parks railings with school children,
planted flowers and helped look after the trees.
During COVID, we cooked and delivered affordable meals to elderly people in the neighbourhood,
checking on people who were isolated and making sure that they had food and support.
We have also helped people in vulnerable situations, including homeless people and more recently refugees as well.
We also supported local schools and community organisations.
This is not something we started doing because of these objections. This has been our way of operating since 2013.
Since opening Love Affair Basement, nothing fundamental has changed in that relationship with the neighbourhood.
The basement is a cultural and community space, particularly supporting q**** communities and other minority groups.
It provides space for artists, performers and community.
We are not trying to turn Iron Square into a nightclub.
The outdoor music we provide is cultural and community focused, live jazz, bossa nova, easy listening and poetry.
We have asked the Council for permission for these activities and have complied with the conditions and times granted.
That brings us to recent events.
On the 8th of August, council officers attended the Czech sound levels and did not identify a problem with the volume.
The music was within permitted period and stopped exactly at 10pm as required.
On the 1st of August, however, we were accused of excessive noise and even of having hidden speakers in the trees.
We had been granted a 10, specifically permitting music until 10pm in the park,
and the speakers were the same portable speakers we always use, they were not hidden.
Again, music stopped at 10pm.
From what we were told by the Council, this complaint was made on the 4th of August via
email three days after the event.
So we respectfully ask, was anyone from the Council present on the 1st of August to measure
or assess the actual sound level at the time?
Was the alleged excessive noise independently established or recorded?
We are absolutely prepared to comply with reasonable conditions, we always have been,
but if a business is given permission to provide music until a particular time...

But if a business is given permission to provide music until a particular time
and complies with that permission,
said permission should have particular practical meaning.
We recognise that summer conditions can mean open windows,
more people outdoors and sound carrying differently,
but this is a seasonal issue affecting hospitality businesses generally.
It cannot by itself justify preventing an established local business
from carrying out an activity that has been properly authorised.
We are not asking the Committee to disregard residents,
we are asking for proportionality in evidence.
This then is not an attempt to change the nature of our business,
it is simply to celebrate the 13th anniversary of a Portuguese love affair,
a women -led and q**** -led business that has been a part of Tower Hamlets for 13 years.
We are asking to celebrate responsibly, with the music finishing no later than 10pm,
and within the conditions agreed with the Council.
We respectfully ask the Committee to consider the actual evidence of noise,
the sound levels observed by Council members,
the number and nature of the complaints, and 13 -year history in this neighbourhood,
and the proportionality of refusing this particular event.
Neighbourhoods need places where people can gather, eat, drink, listen to music,
support artists and build strong community.

This is an application for a standard temporary event notice at appendix 1.
You can find the application, that's pages 26 to 32.
The applicant has explained that the event will take place adjacent to the Portuguese love affair,
which is at 324 to 326 Hackney Road.
And the event is to take place in Iron Square Gardens.
The events take place on the 15th August from 4 until 10pm.
You can find maps of the venue at page 34 which is appendix 2.
Objections have been received from Environmental Health.

To the objector, can you tell me whether the noise patrol did attend on the 1st of August
or whether the only objections were received by email?
I can confirm that out of hours officers did visit on the 1st of August as they were taking
the tents down. The complaint came in at 21 .31 by the time they got there. The event was
finishing because as I said it finishes at 10. So yes I can confirm they did visit.
Thank you chair. And to the applicant it says it's in the adjacent area of Iron Square Gardens.
but I look at the map and I don't know what that means.
Portuguese Love Affair Limited rents a little space
in front of our cafe in the garden.
It rented from the park's department
for maybe four years now.
So it's just a little strip of the park in front of us.
Yes, but I still don't really understand how anyone will actually be able to determine
what that area is.
Is it going to be, it would be helpful if that had been included in the map because
I would look at this and it would seem it could be the whole park.
If you look at the map in front of you, the north part of the park is kind of L -shaped.
So the part that belongs to us, not belongs to us, that we rent out to the council is the little slither.
So it aligns with the entrance to the park.
So next to the bushes contiguous to the buildings
and the same round of buildings as ours.
I don't know if you've got the papers in front of you,
but the map that we've got is at page 34.

Sadly I don't think it's going to be in colour.
but you should see a dashed line across the Hackney Road and then going down into Warner Place.
And then you've got near the junction just to the right of Columbia Road,
you can probably see some bolder outlining which is obviously where the Portuguese Love Affair is, yeah?
And then on the other side of that you've got Irons Square, the road itself,
which runs between yours and the park.
and then you've got another bold rectangle, or edged in bold,
which is obviously the part of the park.
What Councillor Parker is saying,
and is obviously potentially quite a fundamental problem,
is this.
If you turn to page 27, which is your 10th,
please give the address of the premises,
where you intend to carry on the licenceable activities,
or if it has no address, give a detailed description
including the Ordnance Survey references.
And then you say the adjacent area of Irons Square Gardens
is licenced to a Portuguese love affair, and then the address.
And then further down, second box up,
the event will take place in the advancement restricted area
of Irons Square Park.
Now the difficulty that the council has
and what is potentially going to be a problem here
is if this tenant goes ahead, it needs
to be displayed at the premises.
Problem is, it needs to be clear to anyone looking at it,
whether it's a member of the public passing by,
whether it's someone trying to enforce the,
to ensure that the 10 is being complied with.
No one knows where the boundaries are,
because the area adjacent to a Portuguese love affair
is, in fact, the road.
The park could, in fact, be the entire road.
It could be the entire park, that little, I suppose,
dogleg, or whatever, however you want to phrase it.
That just leads straight into the Ion Square Gardens Park
as a whole, which means that it technically covers it, so no one knows where this 10 extends to, and that is incredibly difficult.
And that's the point that the council is trying to make.
And sorry, it's probably worth bearing in mind that this committee has no power to amend a temporary event notice.
They are considering an application for a counter -notice, they're considering what's before them and nothing else.
So do you understand that?
A fair question, thank you for pointing that out. We have been advised in the past to just put the
licence in the front of the Portuguese love affair in the window, which is what we usually do, but
we're very happy to print the licence and put it around. Thankfully, and it is quite helpful in this
So it's very easy to show what the boundaries of the area are on the day to neighbours or whoever has a question about it.
We can definitely take measures to make sure that it's extremely clear what the perimeter of the space that is afforded to us is, if that addresses your question.
Can I just relate to your question?
I just want to ask,
324 to 326 Hackney Road,
what does it exactly relate to that particular address?
324 to 326 is the business premises, it's divided in two.
326 is the oldest premises, it's a café called the Portuguese Love Affair
and that's the one that is closest to that bit of the park.
And in recent years we opened another part of the business that goes underneath.
It's a basement business, that's the 3 -4 bit, which is Love Affair Basement.
Two separate kind of situations and venues, one is a café, the other one is a q**** event space.
That does not relate so much to what's happening in the park.
what relates to the park is a Portuguese love affair
and this is what's been working since 2015.
You kind of, that particular address is related
to the event itself or not?
It's the business premises and I thought I needed to
state what is the business premises.
I think, Chair, the point is that the Portuguese love affair is located at 324 -326 Hackney Road.
They're using that as a reference point for the area that would be licenced under the 10.
As I say, the area that is adjacent to, which in English means next to or adjoining, is in fact the road.
It's not a piece of land on the other side of the road.
but the address is the business address
that business is licenced and they no doubt
using that address just simply as an easy reference.
I just want to say, correct me if I'm wrong though
but I appreciate that the
I don't have any pictures in fact
that the park itself
no doubt there's railings around it
but the bit that you are talking about,
it's not, you know, we can see from that map,
it's not great, that it's a bit of a rectangle,
but it's not actually bounded by railings on all four sides, is it?
So?
So, one side is the side of a building, opposite to ours,
and other two sides have railings,
so the confines of the part that is given to us
are very easily seen on site because they align with the railing.
When you say the parts of the park that it's given to you,
what did you actually have in relation to the park?
Because again, I think that's something else that's not been entirely clear.
Look, bear in mind that English is not our first language.
It's not given to us. We rent from the park's department.
We have a separate agreement with the Parks Department where the number of things we can have outside
the outline of the space we can use is clearer because it's a separate agreement with the Parks Department of

I haven't checked with the parks as yet, but I am aware, I think I put it in my rep that they had,

It has been licenced to APLA by the Parks Department.
I don't know any more than that and maybe before I should have actually checked with Parks,
but I will going forward.
I mean obviously that is something of a difficulty, on the one hand the applicant is saying that they actually have some sort of lease or licence to use
that park and it's gated on all four sides which to some extent might address some of the concerns
but we don't know and it's not something this committee can obviously start looking into halfway through
the meetings, you would just simply have to take it on, I suppose, on face value.
What I understand is the event is taking place in an open to the other public park users,
which doesn't have a boundary or anything.
It does have a boundary, it doesn't mean that it's not publicly accessible.
Can you just make that clear again?
It is within the confines of the park, the park has railings.
It doesn't mean that we close the railing so that other people cannot attend.
It is a public space, we keep it as an open space.
Perhaps an easier way of pushing it then to help the committees,
you do not have exclusive use of that area, would that be right?
If I was in the park and I walked in, I could just walk in, you couldn't stop me,
you couldn't say, we've got a licence, you're on our land, off you go.
And neither would we do that. But we have, commercially we are the only people that can use the park.
That bit of the park. So other businesses wouldn't be able to put tables and chairs outside, for example.
but we wouldn't be able to say to a member of public to not be in the place.
In the place, we wouldn't do that either.
Just quickly, what's the expectation of turnout, do you reckon, at any one time?
For a normal day, for our anniversary, for a specific normal day, we have a limit.
For the event that you are asking licence for?
60 people, 70 people, it's our 13th anniversary.
I think we've requested 70 people in our licence, if I'm not mistaken.
But yeah.
I'm going to teach you on page 29.
Yeah, so as my colleague was saying, that parking space is, so during the event time, any public can walk in,
there's no stopping, you can't say, or you can't come in, because it's so hard.
So basically you don't have control over that space when people can come in or not.
Am I right?

You can use it to put tables and chairs.
That's what you're allowed to do by your group.
We have our own tables and chairs there and we do serve food and drinks there.
The events that we do are open to anything.
It's open to anyone.
It's never paid.
Whatever we do there is always for free for the public.
Anyone that passes by can just stay there and enjoy for free the live music or whatever is happening.
The only thing we have licence to is to put our tables and chairs there and serve food there. That's it.
I've got a question for me.
Yeah, Jonathan just mentioned this.
There are 70 people there.
Expectations of 70 people.
Should there be any more than this?
Since it's an open area and the park is being used by public,
and if it happens to be, should there be any public joining from the park users to the event,
obviously it's going to be something that people will look up to and they might join you.
and it doesn't have any boundary or any kind of limitation that how many people would be joining your party.
How would you tackle with that?
Whatever we do outside and considering that we also are a minority venue,
We always have a bouncer to make certain our guests and whoever is around is protected.
Apart from that we never had any problems.
To be fair, how would you identify that the people are just coming into your party,
they are not invited?
Again, these events that we request licencing for, they are not ticketed events, people don't sign up to come to these events ahead of time, they turn up.
So, given that that's how it operates, people just turn up, then there's no point in distinguishing between what are our usual patrons and new patrons that appear on the day.
Security is merely there to guarantee that we keep to the limit that was granted to us by the Council
and that there is no public nuisance, which actually we've never had an incident,
but in case we do, security is there. That's the only reason why they're there.

I understood from your statement there was a total of four complaints over the two events you received.
Yes, two on the 1st of August.
First of August.

And then we had two emails in following that.
And I'd just like to say with the temporary event notice,
we can't put any, there is no limits or conditions put on a temporary event notice.
I'm not sure what these limits the applicant is talking about,
but with regards to the tens, we look at the ten and then we can't put conditions on it
unless it comes to a hearing like this where yourselves as the committee can put conditions
on the licence, whether it means reducing the noise limits or reducing the numbers because
in my rep I did say that one of the residents had said that they couldn't get into the park
because the park was blocked so clearly people are drifting out onto the walkway into the park.

So basically out of those four complaints and you got two emails, they are not the individual people,
so individual organisations, they are not refitting themselves. Am I right?
I have four complaints to residents that live very close.
Thank you, Chair. I just wanted some more clarification on this licenced area.
Is this licenced only when you're doing temporary event notices,
or is this an area which you use at other times when you might not be doing
sort of on and off sales of alcohol?
Yeah, it's a licence that applies from Monday to Sunday,
so it does not only apply to the temporary events,
we use the space whenever we are open and the weather allows,
We pay it monthly and that's it. It's not specific to temporary events.
And we use it more often without the events. We use it just to serve patrons in the park.

I think just to clarify, I suspect what it is from what we've been saying is that if there is a licence,
what's there is effectively some form of street trading licence, or the public park is within 7 metres of the street,
and we quite often licence businesses to put tables and chairs, but obviously it's not a lease in the sense of it giving any sort of exclusive possession
or any degree of control over the land itself,
which is obviously quite fundamental and rather different.
Just to come back very briefly on a couple of things
that Ms. Kadszau said, and just for the committees
and the applicants' own information as well,
in terms of numbers, what's on the 10 is what they've got.
If the 10 goes ahead and they exceed 70,
then they're not complying with the 10,
which is potentially an offence.
As far as conditions are concerned,
and there can't be any conditions imposed on a temporary event notice unless the event relates to premises that are licenced
and those conditions exist on the licenced or part of it. In that case you can impose conditions.
The problem we've got here is that the premises that are licenced, the Portuguese love affair, are entirely distinct from these premises.
You can't carry any conditions over. So there's nothing there you can do as far as that's concerned.

So, from your brief, on temporary licence, we can't put any conditions on.
Is that what you say?
You can only put conditions on if they exist on a premises licence,
is going to be of all or part of which is going to be encompassed.
Let's just say for the sake of argument, this was an application to extend the hours of a Portuguese love affair
for a temporary event, not this park but just the actual premises themselves.
Let's say they don't know offhand what they run to, let's say they want to go to 4 o 'clock in the morning one morning,
they put in a ten for that, then all of the conditions that exist on that premises licence can be imposed on the ten
because they are in respect to the same premises, but here we're talking about two separate premises
and what you can't do as a committee is say we're going to move effectively these conditions for these premises
over to this other bit of land here. So that's a fairly long way of saying it, but that's why you can't do it.
They're two very separate pieces of land.

In sum, all we would like to say is that we believe that we've been contributing positively to this community,
and all this event refers to is the possibility of celebrating that with the people that have built,
not only our independent business, but a safer area, which is Ironsquare.
It's incredible to see the difference if you've been there ten years ago, as I have, and you go there now,
and we're proud of that and we would like to celebrate that.
We're not asking to celebrate that in an outrageous way. We just want our community, family, friends,
children as well that come to our events to be there with us and
13 years is a lot. Independent businesses don't last as long these days. I think that's all I wanted to say.

saying a positive thing and celebrating. But not everybody in the area wants to celebrate
when they're in their own properties. I think best practical means are not being considered,
the noise limits, if residents are hearing loud music in their properties then clearly
the music is too loud. Whilst this is a separate premises to Portuguese Love Affair, they do
an abatement notice on the actual premises licence, so I won't want to be going, unless I have to,
to serve an abatement notice for an event in Iren Park on the licence holder. That is it. Thank you very much.

The premises that has been applied for is Leaside Yard, which is at 30 Hancock Road,
E33DA.
The applicant has described the nature of the application as an event that will be an
after -carnival duvet party.
Culturally, in some Caribbean islands, the opening of Carnival is celebrated in a fete,
which is with paint, powder or water.
They are looking to create this in a contained manner.
It is due to begin at 6pm and finish at 2am with music and a paid bar and food.
The date that has been applied for is the 30th to the 31st of August from 6 until 2am.
Maps of the area can be found at Appendix 2, which is page 70.
This venue does not have a premises licence.
Objections have been made by the Environmental Protection and from the Police as well.

Thank you. I've been looking at the event notice and the applicant, as I said in my
rep, the applicant has applied for sale of alcohol, late night refreshment and whilst
it was not marked on the application for regulated entertainment, they said this would be an
after carnival party with Pay Bar. My concern is that this is a carnival event in an open
yard up until two in the morning. There are residents in close proximity and I think there
was, did I attach the image? So my concern is that due to this being in an outside, people
people there arriving, drinking, congregating, music, although it wasn't applied for on the
application. The outbreak is going to affect neighbouring residents. The hours are far

So PC Donna Wilcox, I'm a Sector 2 Licence and Officer.
I was allocated this temporary event notice last week.
And initially when I first looked
at the temporary event notice,
I was fully supportive in terms of the after carnival party, there's no issue with that.
What alarmed me was when I did a Google Maps search, I found that the premises, as it was described as an open air event,
it was literally in an industrial estate, but equally when I've looked at the premises, there's very little parking,
There's double yellow lines in fact the whole way round.
So obviously I was concerned.
I also looked and noted that there was quite a lot
of residential properties around.
So my first thoughts were that that potentially
is gonna cause a disturbance to residents
if it's gonna be out in the open air
and there's going to be music.
So what I did was I did attempt to contact the applicant
on the 5th of August and I then carried that on
with an email asking for a little bit more information,
because it may have been that he could have mitigated
a lot of the risk.
The objection notice went in.
I did, on Monday, manage to speak to Mr. Cuffee,
and I explained the concerns that the Metropolitan
Police had in relation to the potential impact
that the noise would have, not to mention
the antisocial behaviour within the area,
because when people, you know, how they get to the event
as well, how are people going to park, when people leave the event, are they going to
be sort of slamming doors and so on and so on.
So in fairness I did ask for event safety management plans, risk assessments and so
on.
I have received those overnight, so thank you very much.
I have gone through those event safety management plans and risk assessments.
There are still a few questions that obviously I haven't received, we have just discussed,
We sadly didn't receive the site plan.
Now from a policing point of view, that would have been very,
very helpful for us because I think that Mr.
Cuffey was referring to music would be moved from the outside
into the inside of a premises.
Now I unfortunately couldn't see that, so that was a bit frustrating.
But nonetheless, the fact that it would finish at two o 'clock in the morning,
I still have concerns about members of the public being disrupted by it.
I have noted that Mr. Cuffey did refer to the fact that leaflets would go out to residents,
but I don't know how far, so hopefully Mr. Cuffey can explain.
It didn't say how far that that would go out to reassure residents.
The other thing as well that I picked up on within the objection notice was I wanted to
know whether or not the landowner had agreed to this event taking place.
I haven't received an update on that so hopefully Mr Cuffey will be able to provide that.
But nonetheless, as I say, there are many, many questions.
It does appear that this isn't going to be a ticketed event, which means that from a
policing point of view, there will be no control, potentially there will be no control in terms
of people coming to the event because word gets round all of a sudden there could be
you know hundreds of people turning up at the gate. It did mention in the event safety
management plan that there would be a suspension at the gates but again my concern from a policing
point of view is if hundreds turn up to that gate what are the four SIA going to do and
hopefully Mr Cuffey and Joelle will be able to advise you. The bottom line is I've got
many questions still unanswered. I have got concerns about this event taking place in
its current format. And for that reason, Chair, I would ask that you reject or refuse this
application.

Good afternoon, Chair. I'm Joelle. I am helping organise the event of Kenrick. Apologies and
advance, it is my first time doing a TEN, so when Kenrick initially asked me to help
him do it, I did not realise how much information I needed to put on the application. Although
we had already had the risk assessment and the noise and first aid kind of, we had a
contingency plan for quite a few things, I wasn't aware that I needed to send it over
to themselves, so again my apologies on that. Once I spoke to Mrs Wilcox, sorry, on Monday,
The file that I had with all of these things was sent off on Monday night Tuesday.
So just a little bit of background.
The event is meant to be a Carnival event and I know that you say in connexion with for instance the security.
There are four securities at the gate. However, the gate opens and closes.
We are planning on having a cordon separating one in and one out with a ticker.
If it does get to a point where we've gotten to 250 and we can see that it's too much,
we're starting to come down, we're stopping taking people when we get to about 280 -290,
and if it does get to 300 then it's a one in one out.
And if it does get to a point where it's an outpour of people then the gates can always be slideshotted.
The security will be inside, there's enough passageway to shut the gates from that bit.
In terms of the site map, I know that you said the counsellors have a copy of the site map.
It literally is what it is on there. It's a big yard, there's containers surrounding the yard.
and Mr. Coffee has a studio which we found approval of the landowner has allowed him to keep events on the property
because he is paying for the studio. So although it's not a licenced business, he is paying for his studio while it's up and running.
It is a music studio so she is very much aware of that then and we have also emailed her too, if you want I can get you a copy of that as well.
we've also emailed her to let her know that the event is going on.
In terms of the neighbours, we have spoken to Mr Pinkerton, is it?
Mr Pinkerton is one of the gentlemen who is part of the Boer Community Council,
so in the group chat, with the residents,
so we kind of wanted to relay the message with him,
He agreed as well that kind of giving him some leaflets, as to whether or not he had told the residents about it, I'm not 100 % sure.
But we had put in a plan to kind of give them leaflets to give them access to one come, access to two if there's a complaint with noise,
In terms of time, I am aware that the licences are up until 2am.
But as I explained to Mrs Wilcox, the event outside will take place until midnight.
At midnight, everyone that is not part of the Dominica community that will be going to Carnival together will leave.
However, we wanted to have permission to sell alcohol until Tiroka.
So it will be indoors, the music will be contained indoors, doors will be closed.
It will be probably about 40 -50 people, no more than that. I'm saying that it's even a lot.
But yeah, and then we'll be going straight to carnival.
There is, you did mention about doors slamming, there is no doors to slam on the outside that could disturb neighbours.
I think in terms of being a nuisance with noise, one of the things that we have to be concerned about the most would be the sound of the music and kind of making sure that it is positioned in a way where the sound is carrying in the correct direction, that it's not disturbing the neighbours across.

This question for me, we have the police representative here saying that there are several questions
or inquiries being unanswered.
So how do you deal with those issues from your side?

I'm not aware of any other problems that we've had.
Again, we had a brief conversation quite late on Monday evening.
I was hoping to catch up with her yesterday, but unfortunately, I had personal issues going on, I wasn't able to.
So it wasn't until coming here that I got an email from her saying that we needed to send the email across to the councillors as well.
So we haven't had a chance to talk, for me to address any concerns that you may have.

Knowing where the building is,
getting to that is the underpass,
crossing into massive big constantly over the president.
What precautions have you thought about those,
or the resident, not just underpasses,
but ASP issues which can really, obviously,
people are going to come in, if you thought about ASP issue on that part
where a lot of resident, a lot of shoppers will be coming from Tesco supermarket,
which is close to 12 o 'clock midnight.
So there's a Japacross pathway going underneath the underpass into a huge residential area.
There'll be influx of people coming in and out from shopping, use the underpass from Tesco,
which is right next to it, and the same Japacross used by the black building and Tesco.
Two things. Number one, we're doing the event on a Sunday. Tesco will be closed by the time we've started.
Number two, if we have run the security as it is, so we've got the fence that we will put,
that people will follow the corner around the building to enter in a single front.
Kind of, car security keep the order of people coming in and out.
So it shouldn't be a situation where anyone is going across to the underpass unless you're coming through that area.
Again, Tesco is closed at 5pm on that day, the event starts at 6pm.
I've checked it because I was needing to meet up with one of the managers to discuss the possibility of using the car park as an evacuation.
means if we needed to, as an assembly point, that's the word, if we needed to, so it was verified that they close at 5 o 'clock on a Sunday.
So they will be closed by the time this party has started.

I've got a question for you to clarify, particularly in terms of the regulated entertainment.
Can we just cheque, obviously on page 65, which is part of the application, it says
premises of open yard surrounded by containers on an industrial site on the side road adjacent to A12
although large amounts, 75 by 60 square metres in the centre of the yard, we use to prevent...
So this is one of the containers hold to my music studio.
So I'm writing this in this, I don't know, this area, if I'm saying it or not, I'll tell the council a matter.
There's no building then, it's just basically an open yard with the containers.
Okay, and you're Mr Cuffling, your music studio, is that a work studio?
I mean what happens in this yard, is it a working yard?
It's an industrial yard, they've got like units with big shutters and they've got furniture shops inside
and they've got the blacksmith shops, but they're all secure and you've got my studio.
So the rest of the area is just open yard really.
So basically I think people all work out the containers, but these are effectively workplaces.
The reason I'm asking in that chair is under the Licencing Act 2003 there is an exemption for workplaces
as defined within, I think it's the workplace safety regulations, 1992,
and that can include not just work premises, obviously like the town hall for example,
but it's places within that people use for access,
and it also includes roads and can therefore include things like yards.
So to that extent, the failure to tick the box for regulated entertainment
doesn't matter because the regulated entertainment is deregulated
in relation to a workplace between 8 in the morning and 11 o 'clock at night.
but the difficulty that the applicant would have,
let's say the applicant premises user would have,
is that from 11 o 'clock at night,
the deregulation would end,
and because you haven't asked to regulate it,
and so you wouldn't be able to play music
anything louder than the background level,
and I don't know how much that therefore then impacts,
because obviously as you've probably heard me say earlier on,
what the committee considers is what's before them,
they can't change anything.
So, if the committee allowed us to go ahead, you obviously are bound by that.
It wouldn't necessarily, I suppose in theory, stop you from putting another one to deal with that specific issue.
But, I do have to flag that and obviously the members know what they're doing.
Yeah, the music system we have, I've got two music systems.
I've got one for my gigs that we're going to use outside.
but inside I've got a different music system which is just a home system.
I mean, if you walk about 30, 40 yards from the studio,
you don't really even hear the music that I have inside.
So the people over there don't really hear it.
Sorry, my apologies. My question was in reference to the regulations.
and she said we didn't take it.
Is it something that we can still do if we wanted to,
or is it something that, for future reference,
or would we have to kind of do the application again
in that case?
So I was saying that partly, obviously,
I guess for your benefit, and also partly
so members know what they can and can't do.
I mean, and it's not about whether people can hear it
at a particular distance.
It's basically the easiest way to think about it,
is if people inside the studio can have a conversation
with the music at normal background level, it's fine.
If they're going to have to shout above it,
which sounds like they probably are, even if you've got soundproofing,
then it is going to get caught by regulated entertainment.
As far as what you can do, I mean, in theory,
you could put in a separate ten just to cover that side of it,
but then obviously the other side of the coin is,
depending what happens, you've got the risk of another objection from the police.
and the noise service, and obviously you'd have to think about what you wanted to do.
But as I say, the committee can't do anything in terms of correcting that.

and to kind of give them an opportunity to reach out to them should there be any issues while we're having the event.
We've tried taking our, we've put our contingency plan in place for the music, the loud music.
We've put something in place for security. We've kind of crossed all our T's and dotted our I's.
So if there's anything that we may not have, that we may have missed prior to giving us a negative feedback,
I would hope that we get a chance to have a look over it and see if it's something that we can actually fix.
I would just like to ask that you guys grant the licence because as you know it's really my first time doing this and I've never done it before.
I'm just going with the help that I can get and I'm willing to do everything in regulation.
Hopefully everything will go okay, if you guys grant me the licence.
I'm not much of a great speaker but I'm a man of my words.

There's questions like how are they going to discourage people being over in high spirits?
What about people congregating outside and leaving the premises in high spirits?
on top of which I think midnight outside with speakers for up to 300 people, I think that is going to cause a significant public nuisance issue.
and also the applicant says after midnight that people will go into the container.
If there's 300 people outside, how many does a container hold?
And what if there's too many people, how is that going to be managed?
I've got a serious concern about public news since having this outdoor event
and I ask that the committee reject the application.

So, as I've already highlighted, the Event Safety Management Plan and the risk assessments
that I received today have actually, sadly, asked more questions about this event.
They haven't really reassured me.
There isn't a reduction in time.
I now know that it's not a ticketed event,
so it's not going to be a controlled event,
which means potentially we're going to have numbers of people
coming to this event.
I say potentially, only through my own experience.
Once word gets round, we could have lots of people at a gate
and then we've got the potential for disorder.
I think, again, going back to the nuisance element,
the public nuisance element, I'm very concerned about that.
It does actually say 300 people,
but actually it does say there will be staff as well, so there will be an additional, it
won't just be 300, there will be staff that will be there as well, so it'll be more than
300 at the premises. So from a policing point of view, I don't feel confident that this
event will be a success and for that reason I would ask that the subcommittee reject the
the temporary event notice.
