May I welcome everybody to this meeting of the London Borough Tower Hamlets Licencing
Subcommittee on Tuesday, the 16th of June, 2026.
My name is Peter Gold and I'm the chair of the Licencing Committee.
This meeting will be held in person and committee members and key participants of presence in
the meeting.
Nobody will be joining us online, but we do webcam our meeting so members of the public
are fully entitled to watch, and we will observe certain rules.
And I make a request.
When I call people to speak, please switch your microphone on, and then when you've concluded
your contribution, switch your microphone off.
If we end up with two switched on at once, it does not help the hearing of members of the public who are trying to listen online.
May I equally say for those at the meeting, only speak under my direction and speak into the microphones.
You don't need to worry, the microphones are designed to pick everybody up.
So you can see I'm sitting backwards and I can still be heard quite clearly in the room, so you don't have to go like that, as people sometimes do or panic.
As we're at the beginning of the year, I am going through everything rather carefully.
I'd like members and council officers to introduce themselves.

record now and I will record later. After we've heard the contributions on all sides,
the members will adjourn to reach a decision and the decision that will be made will be members

for PFC Watney Market, address 273 Commercial Road,
London E1, which is pages 109 to 162 on our agenda.

and people are flicking through dozens of pages trying to work out where they are.

For this item we have the applicant, Mr Mohamed Afrozmiab, present at the meeting.
In terms of objectives, we have Kathy Driver representing Licencing Authority and Mr O 'Leary
representing Environmental Health.
After the application has been presented, the applicant will be invited to speak and
will be given a total of five minutes to make their representation.
The objectors will also receive five minutes each to make their representation.
Once I will let each speaker know when they have one minute remaining.

Thank you, Chair.
As you've said, this application is for PFC 1U Market, 273 Commercial Road, London E12PS.
The applicant is Mr. Mohamed Afrizmia and he's seeking the provision of late night refreshment
under Licencing Act 2003.
The representation is from the Environmental Protection and the Licencing Authority.
Going through the report in Appendix 1, which is pages 116 to 132, you will see a copy of
the new application.
The applicant has described the nature of the premises as a restaurant selling hot food
and drinks with no alcohol.
The application is seeking hours of Monday to Sunday until 4am and same for the opening
hours.
They have an existing licence which is in appendix 2 which is pages 134 to 141.
Appendix 3, pages 143 to 144, shows you the photographs of the premises in the vicinity.
Appendix 4, 146, shows you the site plan.
Appendix 5, pages 148 to 149, shows you the map of the vicinity.
Appendix 6, pages 151 to 152, shows you the other licenced venue in the immediate vicinity.
The representation of environmental protection is in Appendix 7, which is pages 154 to 156.
Appendix 8 contains the representation of the licencing authority, which is pages 158
to 160.
And the conditions to be determined are in Appendix 9, which is pages 162.

So would you like to explain to us why we should consider and grant this application
over and above the objections from environment and environmental health?

The reason why I came in here today for the late night permission,
the local people they are asking me to open the late night especially people
who works in the city because myself I used to work in the city as a driver
and I know a lot of drivers that come on late night so they can have their fresh
food and the local people especially on Ramadan month and special days that
once a late night and every day you have to reject the people have to close the
or early to not to let anyone in but the second thing is like the rent I pay, the landlord
will edit the tax on the quarterly rent so it's quite hard to pay and if I open till
later I can earn some more money and I can cover everything because of the situation and the I'll be
very happy if you can give me the late -night permission. Last time when I was asking the one
of the police officer was asking for to the provide the security door supervision so that time I said
It's the business. I'm doing I can't afford to pay these supervisor
Those supervisor. So what I did I got myself a licence and
I
spoke one of my quality get licence so we can work together and
And especially I'm on the door every night
So if it's possible
To give me the latest permission. I'll be very happy sir
Is that all? I think, have you read the objections from both environmental health and licencing
and is there anything you wish to say on what they have said to mitigate against what they
have said?
Health and department, I have a five star, the health certificates and most of them are
and employees that have the health and safety certificates
and I have a first aid certificate as well

If you turn very quickly to page 159 on the agenda, or I could explain to you, it gives
a very good reason why there is an objection.
And I feel in your opportunity, we've offered you five minutes.
It might be worth you trying to answer some of the questions here, which you haven't.

I mean, effectively, the basis of the objections from both the licencing and from the noise
service, obviously, partly it's about the late hours which are well outside of the council's
policy.
and in particular the in the potential impact in relation to public nuisance by
you staying open later what they say is for example if you're open later you'll
attract more people to the area of all kinds they'll come in cars they'll come
on foot they might be drunk etc etc they might then hang around outside your
premises and cause noise and disturbance to local residents etc so really if you
can try and focus on how you will, if that happens, how you'll address that. You might
want to draw on what goes on now at the moment when you're open till one o 'clock on a Friday
Saturday, for example. Explain to the committee how you manage and deal with those sorts of
problems. Yeah?
Well, I've been open on last Thursday and Friday and Saturday at one o 'clock from last
I have never had any problem.
But I have a next door neighbour,
he is open until 4 o 'clock in the morning.
I never see any problem
in his place and my place.
And there is a few places
that have been open until 2 o 'clock.
And most of them are 1 .30, 12 .30.
They are open but I have seen on the licence,
they don't have that late in licence.
But they are open until late.
There is a local few shops in my place
They are open until two o 'clock.
So on weekdays especially as I said,
I know the local people, the local care privates
that comes in and I'm sure I can,
because of I did the security training
with one of the community place in Peckham
and I used to, I did for eight weeks
and I deal with the law of drunken people in the street
and I manage them.
I never had a problem with them.
So I have that, not that experience,
but little bit experience of this.
And I've been, last one and a half years,
I've been working in my place in the door.
I manage it, I never had any problems.

we will now go to the objectors,
and I'd like to invite the objectors to make their case,
and then members of the panel
will put questions to both sides. Sorry, Cathy Driver first, licencing, sorry.
Thank you, Chair. Obviously, I'm acting on behalf of Levine Miller -Johnson, who made
the representation and referred to her representation at page 157 of the report. Effectively, the
is pretty much almost 24 -7 operation. The current licence permits until 1am at weekends,
but there is a residential block as you can see from the photos at page 144, there's
a residential block literally two shops away effectively, there's one shop and then a
and the residential block and it's obviously opposite Watney Market area as well.
Obviously the Venus has offered some lesser hours, we feel that the hours are excessive,
bearing in mind that here's next to residential premises.
Obviously the additional concern with it being a red route, that any customers will have
to park their vehicles away from the side roads
from the premises which would lead into
Cavell Street and Sydney Street.
And both one of those, particularly Sydney Street,
being a residential area as well.
So obviously the concern will be
where would those delivery drivers
and motorbikes, et cetera, any deliveries,
where would they stop?
And obviously what impact that will have in that area.
We understand obviously Best Kababis is next door and that's operating till 3am at weekends with 2am at weekdays.
But the premises are asking food to be consumed on the premises.
So we feel that obviously operating till 4am, which they could effectively then reopen again at 5am,
that those hours are excessive and is likely to lead to problems,
particularly as a hub for people that may have drunk,
that wish to go in there and eat afterwards,
or just merely groups congregating there,
particularly till the early hours of the morning.
So we think that although the premises,
we can admit that there's no history of complaints at the premises,
but obviously they're only operating
until one o 'clock in the morning presently.
And we feel that those hours operating till 4 a .m.
with the residential nearby and that impact,
that the hours should be less.
Essentially that's our representation really, Chair.
Just as a point of note in terms of the licence,
obviously there is currently a premises licence in place
and they've applied for a new premises licence
in this case rather than a variation so we would ask for any new licence granted that the old one is surrendered.

Thank you, Chair. Good evening, Chair and members. My name is Ono Oleary. I am presenting
Environmental Protection's presentation on behalf of my colleague, Nicolas Caso, who
is currently on leave. My presentation focuses solely on the licencing objective of preventing
public nuisance. Environmental Protection is not objecting to resistance of the business
itself, our concern is whether the proposed operating hours and information provided adequately
protect residents from users.
Framework hours exist to balance economic activity within residential amenities. This
is quite a significant departure which requires robust evidence and mitigation measures, but
that hasn't been provided in this instance.
Our concern extends beyond activities inside the premises.
Noise from customers arriving, waiting, collecting food and leaving the area can impact nearby residents.
Our environmental protection cannot accept the argument that the absence of alcohol means there will be no nuisance.
Public nuisance can occur irrespective of alcohol in ourselves or not.
the application does not adequately demonstrate how public nuisance will be prevented for
the proposed 4am finishing Monday to Sunday. Thank you, chair.
Thank you very much, Mr. Anari. I will begin the questions now and I will begin to the
applicant. Do you do off sales, i .e. do you sell off and people sort of take stuff to
customers at addresses? Can you explain again?
Do you do off sales? Do people ring up, order food and you give it to people on bikes or motorbikes?
I do have it on lines but if you don't want me to say it on line later on I'll be closing because I stop already Uber Eats and the Deliveroo.
Because of the people request I keep one because of the people wanted to deliver it at home but I close it most of the time at late night.
Yes.
Can you switch the thing off?
Let me go back absolutely specifically.
So you have a facility that people can order and food can be taken from your premises and
delivered to an address.
That is correct.
Yes, sir.

I think my concern is, is this issue of going to four o 'clock?
You mentioned other premises next door to go to four o 'clock.
According on page 151, they don't.
I've got their licence.
I've got their licencing hours in front of me, which is Bescabab at 275.
They have up to three o 'clock Friday and Saturday, so they don't go to four.
Why would you wish to go beyond the council's framework hours which are which gives considerable leeway?
People who works in the city as I explained to you earlier on that finish work at one o 'clock three o 'clock three o 'clock
Before they're gone there to have the fresh meal
So that can take away something
I want to sit and eat their stuff and most of the drivers that come and use the bathroom that we have a bathroom there
they want to use the bathroom and
the at the same time they can pick up their foods, but
For a look if it's too late, I don't mind too. I mean if you don't want to give me four o 'clock
Three equipment do it's no problem sir on weekdays and weekends
I think we will examine that but my real concern is the noise and the effect on neighbours.
Nicola Cadshaw pointed out, you can see from the map here, that you are very close to Peterhouse,
which is quite a substantial block of flats and behind it is its sort of sister block also,
which is not a big block, it's smaller but it's still densely, densely populated.
And I my my concern will be is to noise it set and everything else that that brings
of effectively somebody having a
24 -hour premises on their doorstep underneath their windows, which is what you're going for
Sorry, you say one of the highest it road in this so all day long is people are working that road and the late night
We have
And later we have the main road we have a red line and that can park it at late late
night on that side on the right hand side and left hand side and there is exact lane
where the block of flux is so no one can park it over there where the bus stop is where
the council of issues is there so I can't see any like the people who park the car they
make a noise especially when the people come and let them in I don't let anyone go outside
and standing after that having a meal I told them you can't stand outside you have to go into car or please
leave this I go in your car and or finish your composition here and you can go to your car and can
right go please because I have a problem with the licence and
There is the people living above the building and the people who live in next door upstairs
The people are coming for two weeks one week in the day just leave
None of them are permanent resident, I mean residential here.
Maybe one or two families, two people live in there for long.
Otherwise it's a year B &B that comes one night, two nights and there it goes.
I think you've got a very long grasp of Peterhouse.
It's social housing.
It's family housing.
Yes, there is the one on the left hand side building where it's to be car park now is
there building.
Big flats there.
But that site is exactly no one can pocket over there, sir
We're not talking about car parking we're talking about people and the noise that people can bring
I mean people can be on foot people get off an all -night bus, but they can still create noise
You seem to be really you seem to be really in talking only about car parking
Our concern will be the noise that will be generated from customers
going in and out of your shop or even out of your premises and possibly eating
and talking to each other on the street at the very very early hours of the
morning and this is a densely populated area and Peterhouse is social housing
from by town Hamlet's homes I was there at the opening of it so I know exactly
what it is I agree with you sir but always on the customer comes I spoke to
them I said please do not make any noise outside just please go in a car and leave
this side please and they do listen to me as well and the next door is open as
I told you three I seem like they open till four o 'clock so customers are there
and the cab driver they come all night long day. Well I think licencing will
note and I'll draw it to their attention if if next door is opening to four
o 'clock in the morning he'll have a visit from licencing to ask why he's
breaking his licence.

How, if the licence is granted, how will you prevent loitering outside of your premises?
As they are explaining to you earlier on, I said when the customer comes, I said they
come inside, I don't let them go outside and standing over there because they sit inside,
I give them food. After having their food, I said please do not make any noise outside
because I have a problem with the licence, the people who live in outside, I mean the
block of the building and they might have a problem if you speak outside. Every time
I told them and most of the time I'm on the doorstep
I'm staying on the door and I make sure it's no one standing outside my premises
Especially and I have a space inside where they can see and I have a space dusted where they can see it as well
So I don't let anyone go downstairs at nighttime
Because of the I need more stuff to do
Serve them at nighttime. So they only go downstairs to use the bathroom
but I have a best in upstairs in the world where they can wash their hands. So thank you.
Do you also have any signs outside this store reminding your customers about
loitering outside and littering?
Well I am mostly that I'm on the door and I spoke to them so I didn't put in signs or anything but
There is a sign, no alcohols here, no dogs here,
and not any, you can't bring any,
you can't come inside with the hoodie and everything,
but I can put the sign,
please do not hang around outside.
I can do that today or tomorrow.

Yeah, can I ask,
Did you put in this application for those hours based on what you saw from
Your next the next door premises. So were you simply trying to bring your premises in line with the operating hours of other people?

Given that you spoke earlier about accepting that you would accept maybe not the full
till 4 a .m. But a
a smaller extension to your opening hours, is that something that you're open to?
Well I'm very happy he's doing business on his own and I'm not jealous on anything to his business,
but the people have refused me to can you open the late night as the door to drivers,
So plus as I told you like the rent, the landlord, he's asking me for the, I have to pay the V80s so it's quite tough for me to pay them.
So if I can open till late and I got my licence as well, which is I couldn't pay someone on the door like 15 pound hours so I can do the job for myself.
This is the reason why I'm talking the late night, especially the local people, especially
in Ramadan.
People are asking me for the late night food.
So last month was everybody was asking us, I said, no, I can't do, I can't serve because
of the licence.
So I have to close at like 12 o 'clock and one o 'clock.
Ramadan is just one part of the year and it's not all 12 months, so we really do have to
consider the residents we've had.
And if you go to page 159, the Council have made an offer with plus a string of conditions
from Levine.
Would you consider those?
I mean, would you consider going to Sunday to Thursday up to one, and then Friday and
Saturday up to two, plus the conditions?
If it's possible, if you can give me on weekend like Sunday,
Tuesday at one, two o 'clock and the weekend at 2 .30, I'll be very happy.
Please, if you can.
I think we have to consider our residence and you've got this huge block of flats and I think
but going on too late.
I mean, we wish to help you, but I would think up to 1 o 'clock
on a weekday is stretching it.
I mean, residents can expect there will be people
around till 1 o 'clock, and that's still quite late.
You do off sales, which means there is likelihood
of being delivery drivers about on their bikes
and on their little motor scooters,
which itself always creates a noise, and the issue of the weekends, which I think we could
find up to two o 'clock. I mean, I think you could get Sunday to Thursday to one and two
o 'clock up to the weekend. Would you accept that? Save us a lot of problems, plus the
conditions.
I just want to ask, sorry to interrupt, I think on page 159 it says Friday to Saturday
to 2 .30. Just to clarify.

I don't think you received an email saying you could open.
You received an email that explains the situation and said this is what the officers, what the
public protection and enforcement would accept on those times plus conditions.
So I am saying to you, would you accept those times plus the conditions that are on pages
159 to 160?
Well, I've been doing everything from last one and a half years, everything on the paper.
It's only the thing is timing is the difference.

There is an offer here, which is not what you have initially asked for, Sunday to Thursday,

I think we've actually got somewhere.
I just want to ask in relation to the responsible authorities, is there any issues with the
premises next door to the extent that you are aware of it?
We have not had any complaints.
I have never seen any problem until the next term.
I think we got a situation whereby most people accepting on the commercial road, it's a busy
area, it goes beyond midnight.
I think the issue of heading towards four o 'clock in the morning is opening a completely different thing
And I suspect as I said I was at the opening of Peter house, and I reiterate again. It's social housing
It's full of families with you
It's full of people with young children and young children don't want people that for families don't want children
Equally they don't want equally they're very pleased that you're running a business and your business will be successful
So what we've got to do is balance everything, which is why we have the framework hours.
We want to do the best for our residents for you.
And I think we've put a situation on the table, which you said, and officers said that would work.
And I think they may well be visiting any premises along there that open until 4 o 'clock in the morning.
I think we've got we've got we've reached the point now where we can do the summing
up.
Would the objectors like to sum up for a minute each and then I invite the applicant to sum
up for a minute.

For us, this application is to,
wanted to operate during very noise sensitive hours
when residents would presumably expect
some sort of quiet enjoyment of their homes.
For those reasons, we do not accept the 4 a .m. finishing.
But we'll leave it with your,

that one of the premises may be illegally trading
to beyond their licence to four o 'clock,

Firstly, I should point out the correction, as you've already corrected already, it's
Greens and Greens, not PFC, what new market, at 37 Brick Lane, underneath 16PU.
This application is seeking the provision of late night refreshment, and you also have
representation from environmental protection and the licencing authority.
The application has been described as a restaurant and takeaway.
A copy of the application is in Appendix 1, pages 68 to 86.
The hours they are seeking is from 11pm to 5am the following day.
These are the licence of activities and the opening hours have been stayed as 7am to 10pm.
Appendix 2, pages 88 to 89 contains the photos.
Appendix 3, page 91 contains the site plan.
Appendix 4, pages 93 and 94, contains the map of the vicinity.
Appendix 5, pages 96 to 97, contains other nearest licenced premises.

For the record, for anybody watching, the applicant is not present, nor is an applicant's
representative present.
although I will confirm for anybody watching that we do have a full agenda with the applicants,
with the applicants' applications, so we can certainly read from that when we deliberate.
I'm now going to invite Ms. Driver, the licencing officer, to make her objection on this application.
Thank you, Chair. Again, covering for Levine Miller -Johnson in terms of the licencing authority,
and the
presentation is at page 102. The premises fall within the
Council's community impact area.
The hours are applied 24 7 delivery with premises open to
the public 7 a .m. to 10 p .m.
Just for note, late night refreshment commences at 11 p .m.
so it is unregulated prior to the 11 o 'clock.
and obviously it's up to the premises who choose to stop at 10.
Residential properties are located directly above the premises
and obviously we were aware Brick Lane is a busy thoroughfare,
however most business are closed at midnight, particularly restaurants,
and very few open until 2am,
and therefore anywhere operating later is likely to cause a disturbance to those residents,
as you can see at page 96 with detailed venues nearby of which none operate 24 -7. We feel
that the hours are excessive and could be a hub for anti -social behaviour and noise
from the vehicles coming and going and delivery riders waiting for orders and also we feel
that it could be an attraction to customers around the brewery or elsewhere attempting
to access purchase there and I'll go on to state our reasons why. There's nothing in
their application that mitigates any disturbance, particularly for residents living above the
business, delivery drivers and congregation of customers outside, including noise from
people arriving, particularly vehicle movement, if it's a delivery. Also noting obviously
in terms of whether any extract fans are operating throughout the night, which may obviously
impact on those local residents. And obviously with the CIZ, the onus is on the applicant
to show exceptional circumstances that it will not impact on the area. Exceptions obviously
in terms of the Brick Lane CIA for provision of late night refreshment for delivery. However,
we do feel 24 -7 in Brick Lane is excessive. Just going on from the concerns, we have noted
that there's a number of premises that seem to be operating at 37 Brick Lane in terms
for late night refreshment, one in particular called Veggie and Vegan operating until midnight Monday to Thursday and 4am Friday to Sunday.
Sorry Miss Driver, that's not anything that's actually addressed in your representation, it's specifically about the impact of this particular licence, I think I'm going to have to stop you on that point I'm afraid.

Obviously our concern is that the hours are excessive.
We'd also just like to note that the plan that's been provided is a 3D version and not showing sort of firefighting equipment etc.
So if any licence is granted for any period we'd like an updated plan showing that detail as per the regulations.

Chair, this representation concerns the prevention of public news and subjective and proposed
operation of green and grey until 5 a .m. in the morning.
This premises within the Brooklyn and has a residential accommodation directly above,
as my colleague stated.
The proposed late night operation went from 11pm to 5pm.
Again, there are residential flats above.
The original operating schedule did not sufficiently explain how new zones would be prevented.
They provided sufficient detail for delivery and operation risks to residential amenities.
We acknowledge mitigation measures which are proposed which are delivery only after 11
p .m. Maximum two staff on site or on premises, no music after 2200.
Driver controls proposed. The main concern is activity continue until
to 5 a .m. in the morning,
directly beneath residential accommodation.
Deliveries do continue overnight.
Staff activity still remains.
Low background noise levels.
Residents likely asleep at this time,
it's not five in the morning.
We sort of try to be very proportionate.
We offer reduced hours with enforceable conditions.
They refused these reduced hours which we offered.
We also, obviously that's an opportunity for them to withdraw, for me to withdraw the objection,
but they didn't take that.
The quick question here, members, is what we have to determine is 5 a .m. in the morning
compatible with the prevention of public nuisance objectives.
That's the question your chair and committee can answer.
Environmental protection means reduction in hours would better protect residential amenities
while allowing the business to operate.
They still refuse these offers made.

uncovered the issue of why the issue of the request of the
council to break the CIZ quite so extensively of going in to
five o 'clock in the morning.
I can't speak to the applicant, therefore I can't consider it
because I have no idea what the applicant was saying.
I only have what they've written and I've heard Mr. O 'Leary
and Ms. Driver, and the issue of the cumulative thing close to the Chicksand Estate of what
will be, bearing in mind they're saying in the application that it's going to be online,
of delivery drivers potentially on motor scooters going through an incredibly densely populated
area. And you just look at it, and I mention again it's on the Chicksand Estate, which
is one of our most densely populated estates in the borough, as well as one of the most
deprived in the boroughs. There are questions I would have put to the applicant had I been
there. Everything else that the officers have done is clearly outlined for us, so I don't
think I need to address any questions to you. Do colleagues wish to say anything or add
